
Mediation and Family Dispute Resolution
Alternate Dispute Resolution (ADR) incorporating mediation and arbitration, offers affordable and timely options for resolving family law disputes, while allowing you greater control and input into the outcome. The Family Court expects you to consider dispute resolution as an alternate to Court proceedings. In addition, Mediation is now Mandatory (except in certain circumstances) before you can apply for Court Orders in parenting matters.
Traditional Mediation
Mediation is a voluntary dispute resolution process where a professional mediator will guide and assist you and the other party resolve your dispute.
There are many benefits to resolving matters through mediation. Mediation is quicker, less expensive and less formal than the court process and will allow you to have control over the outcome. For these reasons the outcome will generally be better than a Court imposed decision.
Fast Track Mediation
Our bespoke fast track mediation process is designed to progress your financial settlement in the most fair and equitable way.
We ensure both parties receive legal advice and exchange all relevant financial information in a timely way. We then schedule a formal mediation and our mediator will help you resolve your financial matter so you can move forward with your life. The whole process can occur within 4 - 6 weeks.
Arbitration
Parties to a financial dispute can agree to appoint a specialist lawyer/arbitrator to make a decision about their matter. The parties will present their evidence and case to the arbitrator and may have lawyers representing them in the same way as in Court proceedings but without the additional expense of the Court process and delays. The decision will be binding and able to be registered in the Court.
